Subject: L imitations on delegates to a U . S . C onstitution Article V convention . Summary/Major Elements: A United States Constitution Article V convention is a convention of the states gathered to propose amendments to the United States C onstitution. The bill requires d elegates to an Article V convention to be certified and to take an oath regarding the scope of their actions . A delegate who violates the oath is guilty of a felony and may be sentenced to imprisonment for not more than five years, a fine of not more than $10,000, or both. Each delegate must receive certification from the Wyoming Secretary of State, must follow legislative instructions and statutory requirements , and may not vote for any unauthorized constitutional amendment. The bill clarifies that existing state statutes regarding a state convention refer to a state convention to ratify a proposed federal C onstitution amendment. The bill also eliminates provisions for a county convention and the precinct-level meetings of electors to choose delegates to a county convention. Comments: The bill r equires a l egislative a ppointmen t in the event of a federal A rticle V convention . The Wyoming S enate shall elect three members of the S enate to serve as delegates, and the members of the House of Representatives shall elect three members of the House of Representatives to serve as delegates. The president of the S enate and the speaker of the H ouse shall assign alternate s when necessary.
